Welcome to the Harpenden Medical Patient Portal (“the App”). These Terms of Use (“Terms”) govern your access to and use of the App, operated by Harpenden Medical (“we”, “us”, “our”), a private health and wellness clinic located at The Old Stables, Pipers Lane, Harpenden, AL5 1AJ.

By accessing or using the App, you accept these Terms in full. If you disagree with any part of these Terms, please do not use the App.

The App provides registered patients of Harpenden Medical with secure access to their health information, including appointments, laboratory results, clinical letters, and medical documents. Certain general information such as our team, opening times, and contact details is available without registration.

The App is intended for informational purposes only. Content displayed in the App does not constitute medical advice, diagnosis, or treatment. Always seek the guidance of a qualified healthcare professional with any questions regarding your health.

To access your health records, you must register and sign in using our secure authentication system. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorised access to your account

We reserve the right to suspend or terminate your access to the App at any time if we reasonably believe your account has been compromised or these Terms have been breached.

Harpenden Medical owns all rights to the intellectual property, content, and material contained in the App, and all such rights are reserved. You are granted a limited licence only, subject to the restrictions provided in these Terms, for purposes of viewing your personal health information and the general content of the App.

You are strictly restricted from all of the following:

• Publishing or copying any App material in any media
• Selling, sublicensing, and/or otherwise commercialising any App material
• Publicly performing and/or showing any App material
• Using the App in any way that is, or may be, damaging to the App
• Using the App in any way that impacts other users’ access
• Using the App contrary to applicable laws and regulations, or in a way that causes, or may cause, harm to the App, or to any person or business entity
• Engaging in any data mining, data harvesting, data extracting, or any other similar activity in relation to the App
• Attempting to access another patient’s health records or any data you are not authorised to view
• Attempting to reverse-engineer, decompile, or interfere with the App’s security measures

While we strive to ensure accuracy, the health information displayed in the App is sourced from our clinical management system and may be subject to processing delays. Information in the App should not be relied upon as a substitute for professional medical advice.

The App is provided “as is,” with all faults, and Harpenden Medical makes no express or implied representations or warranties of any kind related to the App or the materials contained within it. We do not warrant that the App will be available at all times or that it will be free from errors or interruptions.

In no event shall Harpenden Medical, nor any of its officers, directors, and employees, be liable to you for anything arising out of or in any way connected with your use of the App, whether such liability is under contract, tort, or otherwise. Harpenden Medical, including its officers, directors, and employees shall not be liable for any indirect, consequential, or special liability arising out of or in any way related to your use of the App.

Nothing in these Terms shall exclude or limit liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

You hereby indemnify to the fullest extent Harpenden Medical from and against any and all liabilities, costs, demands, causes of action, damages, and expenses (including reasonable legal fees) arising out of or in any way related to your breach of any of the provisions of these Terms.

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.

Harpenden Medical reserves the right to revise these Terms at any time. By continuing to use the App, you are expected to review these Terms on a regular basis to ensure you understand all terms and conditions governing your use of the App at any time.

Harpenden Medical shall be permitted to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification or consent required. However, you shall not be permitted to assign, transfer, or subcontract any of your rights and/or obligations under these Terms.

These Terms, together with our Privacy Policy, constitute the entire agreement between Harpenden Medical and yourself in relation to your use of the App, and supersede all prior agreements and understandings with respect to the same.

These Terms will be governed by and construed in accordance with the laws of England and Wales. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
